Robert D. Hooks is a partner in the firm where he is a member of the Litigation, Secured Lending and Financial Recovery Departments and Construction Practice Group. He has a broad-based business and commercial litigation practice, including construction disputes, real estate issues, business contracts and collection matters.

Mr. Hooks received his J.D. degree, magna cum laude, and was class valedictorian of Albany Law School of Union University. He received his B.A. degree from Harpur College.

Representative Matters:

  • Enjoined world’s largest retailer from expanding store location in contravention of its lease.
  • Successfully prosecuted breach of contract and fraud claims against prominent state bank (obtaining settlement in excess of $1 million dollars).
  • Successfully represented national telecommunications company in warranty claim against manufacturer of cell towers (obtaining settlement in excess of $700,000).
  • Successfully dismissed two homeowners’ association actions against builder/sponsor alleging damages in the millions.
  • Litigated payment claims against national surety companies in state and municipal construction projects.
  • Defended national surety companies in payment claims involving state and municipal construction projects.
  • Received trial verdict against architect for professional errors and omissions.
  • Represented multiple school districts in construction disputes.
  • Represented numerous manufacturers in business disputes with commercial suppliers, vendors and customers.
  • Extensive real estate litigation experience (including adverse possession actions, boundary line disputes, commercial and residential evictions, real estate purchases, actions for waste, partition, trespass, etc).
  • Successfully represented sales representatives in commission disputes against employers.
  • Successfully represented employers in sales commission disputes.
  • Extensive construction litigation experience.
  • Extensive collections practice (both commercial and retail).
  • Extensive federal and state court experience.
