In today's competitive and global marketplace, employee benefit programs of all kinds have emerged as essential tools used by companies in every industry sector to attract, incentivize, and retain their key contributors. Our attorneys are actively involved in all areas affecting employee benefits and executive compensation. A significant portion of the practice is planning, drafting and updating qualified and nonqualified retirement plans, as well as assisting clients with on-going compliance matters, and working with the Internal Revenue Service and Department of Labor on various closing agreements, audits and investigations. We assist clients in the design and implementation of: ESOPs; safe harbor 401(k) plans; equity and non-equity-based plans; and incentive compensation programs and “top-hat” plans for executives.
An important part of our practice is advising employers whose qualified plans have either document or operational failures. We represent employers with respect to self-correction or submission of a proposed correction to the Internal Revenue Service or Department of Labor under their correction programs. We regularly advise individuals who are acquiring businesses participating in employee benefit plans that are jointly sponsored by both labor and management, pursuant to one or more collective bargaining agreements on bonding and withdrawal liability.
